(2026)"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-15362 size-thumbnail\" src=\"https:\/\/nrlawyers.com\/wp-content\/uploads\/2023\/09\/ME-NEW-FINAL-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/p>\n<p>Charges of Sexual Assault against A.B. stayed due to unreasonable delay pursuant to Section 11(b) of the <em>Canadian Charter of Rights and Freedoms<\/em> in the Ontario Court of Justice, Toronto.\u00a0\u00a0 A.B. was charged with a serious sexual assault involving his former girlfriend.\u00a0 The Crown was seeking a custodial sentence and various ancillary orders including registration with the sex offender registrar if A.B. were found guilty.\u00a0 The matter had a lengthy history of delay with a significant portion of delay attributable to the Crown as well as significant institutional delay.\u00a0 Michael Bury spent considerable time assessing the delay and conducting recent case law research to determine the prospects of making a successful stay application argument before the scheduled trial date.\u00a0 The stay application was argued in advance of trial and after hearing from both Michael Bury and the Crown, the Judge hearing the application agreed that A.B.\u2019s right to a trial within a reasonable time had been violated and ordered the charges stayed for this reason.<\/p>\n","protected":false},"template":"","success_category":[118,119],"class_list":["post-30006","success_story","type-success_story","status-publish","hentry","success_category-all-success-stories","success_category-sexual-assault-domestic-assault-and-other-violent-crimes"],"_links":{"self":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_story\/30006","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_story"}],"about":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/types\/success_story"}],"wp:attachment":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/media?parent=30006"}],"wp:term":[{"taxonomy":"success_category","embeddable":true,"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_category?post=30006"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
