(2025)"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/nrlawyers.com\/wp-content\/uploads\/2023\/09\/ME-NEW-FINAL-150x150.jpg\" \/><\/p>\n<p>Client found not guilty of 5 counts of sexual assault, and 1 count of break and enter into dwelling following a three-day trial in the Ontario Court of Justice, Toronto.\u00a0\u00a0 S.H. retained Michael Bury of Neuberger &amp; Partners LLP to defend him.\u00a0 S.H. and C.H. began a dating relationship in November 2019 and ended December 2022.\u00a0 S.H. was 21 years old at the time and the complainant was 48 years old.\u00a0 S.H.\u00a0 would work the night shift and stay awake all night while the complainant would go to bed. The complainant would take sleeping pills to help her sleep.\u00a0 The pills were over the counter and would allow her to sleep through the night. C.H. would take the sleeping pills aspart of her nightly routine and go to bed. She would sleep on herstomach but was allegedly awoken to the blanket being pulled off with S.H. naked on top of her on four separate occasions. \u00a0C.H. testified that S.H. would have intercourse with her even though she claimed that she did not consent.\u00a0 At some point, the relationship ended and S.H. met a new partner.\u00a0 C.H. repeatedly tried to \u201cwarn\u201d the new partner about S.H.\u00a0 Additionally, C.H. decided to report the matter to the police after considerable time had passed following her break-up with S.H.\u00a0 At trial, the main issue was both credibility and reliability.\u00a0 S.H. testified in a straightforward manner.\u00a0 Michael Bury cross-examined the complainant at length about the absence of details regarding the allegations and her displeasure about S.H. moving on to a new relationship.\u00a0 Her reliability as a witness was successfully challenged leading the trial judge to find S.H. not guilty of all sex assault charges.<\/p>\n","protected":false},"template":"","success_category":[118,119],"class_list":["post-30040","success_story","type-success_story","status-publish","hentry","success_category-all-success-stories","success_category-sexual-assault-domestic-assault-and-other-violent-crimes"],"_links":{"self":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_story\/30040","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_story"}],"about":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/types\/success_story"}],"wp:attachment":[{"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/media?parent=30040"}],"wp:term":[{"taxonomy":"success_category","embeddable":true,"href":"https:\/\/nrlawyers.com\/6ixDev-v2\/wp-json\/wp\/v2\/success_category?post=30040"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
