S.S. مایکل بری از شرکت حقوقی Neuberger & Partners LLP را برای وکالت خود استخدام کرد. پرونده به محاکمه رسید و با وجود برخی شواهد که S.S. را به این اتهامات مرتبط می‌کرد، مایکل بری با بازجویی متقابل دقیق از کارآگاه مسئول پرونده، ضعف‌های پرونده را نشان داد. پس از مذاکرات گسترده با دادستان پس از بازجویی‌ها، دادستان  ضعف ادله استنادی  علیه S.S. را پذیرفت و با وجود اینکه محاکمه آغاز شده بود با پس گرفتن تمامی اتهامات موافقت کرد. - [جرایم مربوط به اموال، نگهداری اموال دزدی و منافع حاصل از جرم](https://nrlawyers.com/recent-successes-farsi/property-crimes-possession-of-stolen-property-and-proceeds-of-crime-farsi/): اتهام «آسیب زدن به اموال  زیر حد معین(5000$)» پیش از محاکمه در تورنتو پس گرفته شد. موکل در ارتباط با یک حادثه جاده‌ای به «اسیب زدن  زیر حد معین» متهم شده بود. گریس کوندلو از دفتر حقوق  (وکلای جنایی تورنتو) برای دفاع از موکل انتخاب شد. شاکی ادعا کرد که موکل تلاش کرده بود خط خود را تغییر دهد و او مجبور شد به سمت چپ حرکت کند تا از برخورد جلوگیری کند. شاکی همچنین ادعا کرد که موکل از خودرو پیاده شده و "با مشت به قسمت صندوق عقب ضربه زده" و باعث خسارتی به مبلغ ۴۵۰۰ دلار شده است. خانم کوندلو توانست ثابت کند که شاکی کسی بود که حادثه را شروع کرد و ابتدا یک بطری آب به خودروی موکل پرتاب کرد که باعث خسارتی به مبلغ ۹۰۰ دلار شد. با توجه به شواهد، دادستان با صدور یک «قرار صلح عرفی» موافقت کرد و اتهام «آسیب زدن زیر حد معین» را پس گرفت. - [رانندگی در حالت مستی، رانندگی خطرناک و سایر جرایم مرتبط با رانندگی](https://nrlawyers.com/recent-successes-farsi/impaired-driving-over-80-dangerous-driving-and-other-driving-related-offences-farsi/): رانندگی در حالت مستی، رانندگی خطرناک و سایر جرایم مرتبط با رانندگی Rex v. P. A (2023) اتهام «عدم ارائه نمونه تنفسی» پس از چهار روز محاکمه در دادگاه تورنتو متوقف شد. حدود ساعت ۲ بامداد در مرکز شهر تورنتو، مشاهده شد که P.A. با خودروی خود رانندگی می‌کرد. ادعا شد که او در مسیر مخالف یک خیابان یک‌طرفه رانندگی می‌کرد. همچنین ادعا شد که پس از توقف، P.A. برای چندین دقیقه نتوانست گواهینامه رانندگی، بیمه و مجوز خودرو خود را پیدا کند. به دلیل این رفتار ادعایی، افسر بازداشت‌ کننده تصمیم گرفت که از P.A. درخواست کند که نمونه تنفسی خود را به دستگاه بررسی مجاز ارائه دهد. P.A. پس از تلاش‌های مکرر نتوانست نمونه‌ای ارائه دهد و سپس به دلیل «عدم ارائه نمونه» دستگیر شد و جریمه‌ای نیز برای رانندگی در جهت مخالف خیابان دریافت کرد. P.A. یویکا جوهری از دفترحقوقی Neuberger & Partners LLP (وکلای جنایی تورنتو) را برای دفاع در برابر این اتهامات استخدام کرد. پس از بررسی دقیق مدارک، یویکا جوهری متوجه شد که افسر بازداشت‌کننده، حق P.A. طبق بند ۱۰ (ب) منشور حقوق- حق برخورداری از مشاوره با وکیل- را نقض کرده است. یویکا جوهری درخواست توقف اتهامات را مطرح کرد و این پرونده را به مدت ۴ روز پیگیری کرد. در جریان محاکمه، یویکا جوهری افسر بازداشت‌کننده را مورد بازجویی متقابل قرار داد و توانست نشان دهد که افسر بیش از دو ساعت درخواست P.A. برای صحبت با وکیل را نادیده گرفته است. همچنین، دفاع نشان داد که مشکلی سیستماتیک در پلیس وجود دارد که به تعهدات خود در تسهیل دسترسی به وکیل هنگام درخواست متهم عمل نمی‌کنند. در نهایت، توقف اتهام «عدم ارائه نمونه تنفسی» تصویب شد و جریمه رانندگی نیز پس گرفته شد. این نتیجه مطلوب برای P.A. اهمیت زیادی داشت زیرا او یک مقیم دائم بود و محکومیت می‌توانست به اخراج او منجر شود. - [قاچاق مواد مخدر، توطئه، نگهداری مواد مخدر و جرایم مرتبط](https://nrlawyers.com/recent-successes-farsi/drug-trafficking-conspiracy-possession-of-drugs-and-related-offences-farsi/): خانم M.S. به اتهام نگهداری مواد مخدر با هدف قاچاق شامل کوکائین، فنتانیل و هروئین از دادگاه اوریلیا متهم شد. او با مردی رابطه عاشقانه داشت و برای دیدار او به خانه‌اش در اوریلیا رفته بود. زمانی که او در آن خانه حضور داشت، پلیس با داشتن حکم بازرسی وارد خانه شد. مأموران پلیس تمامی افراد حاضر در خانه، از جمله M.S. را بازداشت کردند. در جریان بازرسی، پلیس مقدار زیادی مواد مخدر مختلف، ابزارهای مربوط به مصرف مواد و مقادیر زیادی پول نقد کشف کرد. به همین دلیل، M.S. به همراه دوست‌پسرش و چند نفر دیگر به دلیل ارتباط با مواد مخدر و پول نقد کشف‌شده، متهم شد. - [قتل، اقدام به قتل، سرقت و سایر جرایم خشونت‌آمیز](https://nrlawyers.com/recent-successes-farsi/homicide-attempt-murder-robbery-and-other-violent-crimes-farsi/): موکل پس از سه هفته محاکمه از اتهامات قتل درجه دوم و قتل غیرعمد تبرئه شد. ادعا شده بود که در قتل یکی از اعضای باند رقیب دست داشته است. کریستوفر اسی از دفتر حقوقی به عنوان وکیل مدافع او انتخاب شد. در جریان محاکمه، کریستوفر توانست از طریق بازجویی متقابل از شاهدان معرفی شده از سوی دادستان، ثابت کند که در هیچ یک از اقدامات مربوط به درگیری که با یکی از دوستان رخ داده بود، شرکت نداشته است. در واقع، این دوست A.S. بود که باعث مرگ طرف دیگر شده بود. بازجویی متقابل، شهادت شاهدان عینی را تضعیف کرد و در پایان کریستوفر اسی درخواستی برای صدور حکم مستقیم بی‌گناهی در مورد اتهام قتل درجه دوم و اتهام کمتر قتل غیرعمد مطرح کرد. این درخواست موفقیت‌آمیز بود و حکم بی‌گناهی در هر دو اتهام صادر شد. شهادت شاهدان عینی به‌ طور ذاتی مشکل‌ساز است و باید با دقت بررسی شود تا از محکومیت‌های نادرست جلوگیری شود. خوشبختانه بی‌گناه شناخته شد. - [سازمان‌های جنایی، پول‌شویی، جرایم توطئه](https://nrlawyers.com/criminal-organizations-money-laundering-farsi/): سازمان‌های جنایی، پول‌شویی، جرایم توطئه - [جرایم مربوط به سلاح](https://nrlawyers.com/recent-successes-farsi/weapon-offences-farsi/): اتهامات نگهداری سلاح گرم پر و بدون مجوز (۲ مورد)، نگهداری اموالی که از جرم به دست آمده، - [قاچاق انسان، فریب دادن، کسب منافع مادی از خدمات جنسی و دریافت خدمات جنسی در ازای پرداخت وجه](https://nrlawyers.com/recent-successes-farsi/human-trafficking-farsi/): موکل از اتهامات حمله، خفگی در حین حمله، دو مورد قاچاق انسان، دو مورد کسب منفعت مادی، فریب دادن، و تبلیغ خدمات جنسی، پس از یک محاکمه شش روزه در دادگاه نیومارکت، بی‌گناه شناخته شد. U.M. توسط تأمین‌کننده ماریجوانای خود خواسته شد تا به یک زن جوان که از شمال انتاریو آمده بود کمک کند.
