Criminal charges of operating a motor vehicle with more than the legal limit of alcohol in his body withdrawn when client pleads to a Highway Traffic Act violation of careless driving. He was immediately arrested and taken to the police station. At the station he blew over 100 milligrams of alcohol within 100 milliliters of blood. After putting together a carefully crafted package of material, counsel was able to convince the Crown to withdraw the criminal charge and permit the client to plead to a Highway Traffic Act violation.
