Called to the bar in February of 1993, Joseph A. Neuberger is one of Toronto’s most respected, award winning and sought-after criminal defence lawyers in Canada. As a Certified Specialist in Criminal Law with the Law Society of Ontario, he has acquired unique trial and appellate experience qualifying him as an expert in criminal law. In addition, he has a master’s degree in law – specialty in criminal law, adding to his experience and academic achievements. He is a published author of both the Sex Assault Law Update Newsletter published quarterly and “Assessing Dangerousness – A guide to the Dangerous Offender Application Process”, both published with Thomson Reuters Canada. Joseph Neuberger leverages over three decades of trial experience to have built a highly respected criminal defence firm with a proven track record of success. His skilled cross-examinations have resulted in over 1,000 acquittals and withdrawals, and his firm has been recognized among Canada’s Top Criminal Law Boutiques.
Mr. Neuberger has extensive trial experience across the full spectrum of serious criminal matters, including sexual assault, sexual exploitation, luring, domestic assault, homicide, fraud, drug-related offences, and other serious offences. He has successfully conducted over 150 jury trials and is known for his rare ability to connect with juries on complex and serious criminal matters.
Widely regarded as a leading authority on cross-examination, sexual assault cases, and the handling of expert witnesses, Mr. Neuberger is a featured speaker at legal education conferences and workshops across the country. His opinions are frequently sought by the media on high-profile cases.
During his career, Mr. Neuberger has conducted hundreds of sexual assault trials and has been recognized by the Law Society of Ontario as an expert in sexual assault law Law Society of Ontario v. Corcoran, 2024 ONLSTH 108 (CanLII). Given his extensive experience in sexual and domestic related cases, he along with Diana Davison, launched a highly successful podcast on YouTube, Not on Record, to assist in the education on important criminal justice issues, with a focus on false allegations of sexual assault and domestic assault related charges. Not on Record is widely followed and highly regarded as a source of expert information in criminal law.
Mr. Neuberger’s expertise extends beyond the defence bar. He has been regularly retained by government agencies for high-profile Public Inquiries and Inquests and was retained by the Provincial Government to act as lead counsel on its behalf in the Cornwall Public Inquiry into historical allegations of sexual abuse. He is also frequently consulted by the Ministry of the Attorney General and the Ministry of the Solicitor General and Correctional Services on Coroner’s Inquests and prosecutions under provincial legislation. In 2002, he was appointed to the Ontario Review Board as alternate chairperson and legal member and remained on the board for 20 years.
A dedicated leader in the profession, Mr. Neuberger is a Past President of the Toronto Lawyers Association, where he served as a trustee beginning in 2004, joined the executive in 2009 as secretary and then treasurer, and assumed the presidency in 2014. He served as Editor-in-Chief of the Toronto Law Journal, the Association’s online publication, from 2004 to 2010.
He is an active member of the Advocates’ Society, the Toronto Lawyers’ Association, The Criminal Lawyers’ Association, and the American Association for Justice.
Mr. Neuberger has devoted much of his career to advancing the skills of the criminal defence bar. Since 2002, he has served as co-chair and program author for The Advocates’ Society’s Criminal Litigation Skills Certificate Program, designing and leading courses that have become fixtures of continuing legal education in Ontario, including:
He has served as an Instructor in the Criminal Section of the Bar Admission Course for the Law Society of Upper Canada, is a Guest Lecturer on Dangerous and Long-Term Offenders at Queen’s University Faculty of Law and has presented on extradition law as a panel member for the National Judicial Institute at the Court of Appeal of New Brunswick. He has also addressed the Toronto Police Service Behavioural Unit and associations of social workers and mental health professionals on domestic, sexual, and violent offences.
Mr. Neuberger is the author of Assessing Dangerousness: A Defence Guide to the Dangerous Offender Application Process, published by Thomson Reuters Canada. The Supreme Court of Canada has relied upon Mr. Neuberger’s text in deciding cases involving Dangerous Offender Applications.
He is also co-author of the Sex Assault Law Update Newsletter, a quarterly publication highlighting recent judgments on sexual assault and related cases.
