Charges of Sexual Assault x 2 and Sexual Exploitation withdrawn, Superior Court, Owen Sound. W.M. met a younger lady through an ad posted for a travel companion. The two met, seemed to connect, and agreed to travel together. W.M. took her shopping and they picked some places to visit in Ontario. They both packed and travelled. At their destination in Owen Sound, the lady passed a note to the hotel reception clerk that she needed help. She wrote in the note that she was kidnapped and suggested she was sex trafficked. Police attended and W.M. was arrested. Joseph Neuberger was retained to defend the case. Diana Davison, a men’s rights advocate with the firm was assigned to the file. In addition, a private investigator was retained by Joseph Neuberger to secure and possibly obtain all CCTV footage of all places and hotels visited by W.M. and the complainant. The private investigator was successful to secure most video footage and most was provided to Joseph Neuberger. After disclosure was received and reviewed, Joseph Neuberger sought an order to return the cell phone and dash cam seized by police for a defence digital extraction. All retrieved messages, and video obtained and disclosed by the Crown completely discredited every aspect of the complainant’s statements. In addition, there appeared to be a mental health issue outlined by the complainant in one of her statements. Further disclosure requests were made about the mental health issues. Joseph Neuberger and Diana Davison prepared a detailed chart and memo for the Crown breaking down the statements and contradicting every aspect with messages and video evidence. Extensive pre-trials between the Crown and Joseph Neuberger were extremely productive. Joseph Neuberger provided the memo and chart to the Crown and all digital evidence was shared. The Crown rightly concluded that there was no reasonable prospect of conviction as the complainant fabricated the allegations. The charges of sex assault and sexual exploitation were withdrawn.
