Charges of domestic assault, forcible confinement and mischief withdrawn prior to setting a trial date, Orangeville.  R.C. and his wife were horsing around, and a raw comment was made that resulted in an allegation of assault and other criminal allegations.  Police were called and R.C. was arrested.  Joseph Neuberger and Grace Condello of Neuberger & Partners LLP were retained to defend the charges.  After receiving the disclosure, the statement of the complainant – R.C.’s wife – was incredibly inconsistent alleging that he struck her after she told him he was drunk to her striking him after he said she was being ….  The complainant alleged R.C. grabbed her and tried to take her phone.  However, police dash cam video of the complainant disclosed no such allegations and that she was just angry and wanted him removed from the house.  After very productive discussions with the Crown, Grace Condello and Joseph Neuberger worked out with the Crown that the parties could benefit from therapy and then a withdrawal once successfully completed. The Crown took a very thoughtful and pragmatic approach.  Ultimately, the charges were withdrawn.
