Appeal granted at the London Superior Court of Justice for Ontario. The appellant was convicted of one count of uttering threats and two counts of domestic assault against the Complainant, his ex-wife, despite significant inconsistencies in her evidence. Those inconsistencies concerned the frequency and nature of the alleged abuse; the trial judge dismissed them as the expected result of filtering mechanisms inherent in criminal legal proceedings. Mr. Whitfield argued successfully on appeal that such a manner of resolution was unknown to law, unsupported by the trial record, and contrary to the integrity of the legal profession and the police. The appellate judge granted the appeal and a new trial has been ordered.
