← More Sexual & Domestic Assault Wins success stories

Client found not guilty of five counts of sexual assault after a four-day trial in the Ontario Court of Justice, Newmarket. P.L. had been a massage therapist for over 15 years at the time he was charged for allegations of three clients. Joseph Neuberger of Neuberger & Partners LLP was retained. The crown brought a similar act application to support cross-count evidence to bolster the credibility of the complainants. This was challenged at trial. Each complainant had described somewhat similar issues regarding the massages but many of the factors were not unique, and many were simply the factor of the place and circumstances in which each allegation arose. For example, each complainant was female. Each were getting massages to sensitive areas and by a male therapist. At trial, careful attention was paid in cross-examination of the message technique, consent forms signed to the extent of the injuries being treated, and the therapeutic approach to each of the patient/complainant. The Crown did not call an expert in their case however, in cross-examination Joseph Neuberger challenged the complainants on the areas that needed to be treated how to properly address each of their injuries and each complainant seemed to suggest that they knew better as to how to treat their injuries. Two complainants had been long standing client’s and the third was a first-time client, but all had specific injuries that required treatment. Part of the defence was that P.L. because he was in his mid-50s at the time of the alleged sexual assaults, was experiencing arthritis in his hands, and back. He too had injuries from his previous career and at times may have been sloppy in draping techniques and touches, but he did not do anything for a sexual purpose. Each complainant described touching in sensitive areas but not any type of penetration. The areas described that were alleged to have been touched on purpose were all possibly touched incidental to his legitimate massages techniques that were proper legitimate techniques to address their issues. One complainant who had been a client for over 5 years kept returning and only stopped because he was no longer working at the clinic. That complainant was aggressively challenged on her allegations and frankly tried to mislead the court about how her injury had been treated in the past and during the impugned sessions. P.L. testified and gave consistent, logical, and enthusiastic evidence about how he treated the three complainants. He was not shaken in cross by the Crown and was believed by the judge. The similar act application was denied, and P.L. was found not guilty of five charges of sexual assault.
