Judge throws out drug charges after York police violate man’s Charter rights

On behalf of Neuberger & Partners LLP posted in Drug Trafficking on Monday May 11, 2015.

When police officers violate one person's Charter rights, everyone's constitutional rights are threatened. Still, improper police conduct happens more often than you might think. Recently, a Superior Court justice ruled that York Regional Police officers violated a man's Charter rights in a number of ways, and that the drug charges against him should be dropped. In the ruling, the judge characterized the police officers' actions as a "catastrophe." The case...

Police claim GTA residents were selling drugs from Niagara Falls hotel

On behalf of Neuberger & Partners LLP posted in Drug Trafficking on Wednesday February 18, 2015.

When multiple people are arrested in connection with alleged drug trafficking, the extent to which each party is involved, if at all, is often not immediately clear. People may find themselves facing a serious drug charge simply because they were in the wrong place at the wrong time. To convict a person of a drug offence, the prosecution must make an evidentiary connection between the defendant and the drug in question. If...

Police dragnet sweeps up 33 in Southwestern Ontario

On behalf of Neuberger & Partners LLP posted in Drug Trafficking on Wednesday December 31, 2014.

With large-scale drug investigations, there is a risk of innocent people getting caught up in the dragnet. Sometimes police and prosecutors become overzealous and charge people whose only mistake was being in the wrong place at the wrong crime. After all, just because you are in the presence of someone in possession of drugs does not necessarily mean that you are guilty of a drug offence. Thirty-three people have been...

15 arrested in connection with alleged drug trafficking in GTA

On behalf of Neuberger & Partners LLP posted in Drug Trafficking on Wednesday November 26, 2014.

Police departments in the Greater Toronto Area sometimes combine their significant resources to conduct sweeping investigations into the trafficking of illegal substances. While such investigations may result in the seizure of large amounts of drugs, innocent people can easily become caught up in the mix by simply being in the wrong place at the wrong time. Fifteen people were recently arrested after officers from numerous departments searched 15 locations in...

Evidence thrown out after officer ‘fabricated’ drug transaction

On behalf of Neuberger & Partners LLP posted in Drug Trafficking on Monday September 29, 2014.

Police officers must follow proper procedure when gathering evidence to obtain a search warrant. A mistake at any point in the process could later result in evidence being thrown out. Often such mistakes are unintentional, but occasionally police officers are found to have brazenly broken the law in the pursuit of criminal charges. Recently, an Ontario judge threw out the evidence against a convenience store employee who was charged with...

Police cast wide net, arrest 24 on drug-related charges

On behalf of Neuberger & Partners LLP posted in Criminal Defence on Saturday August 02, 2014.

In the midst of large-scale police investigations that lead to multiple arrests, sometimes innocent people are in the wrong place at the wrong time and soon have to confront criminal charges. Overcharging is another common problem in police investigations that cast a wide net. While there may be someone who committed a crime, that doesn't necessarily mean that all parties involved should be charged with the same offence. In any...

His football career has since ended due to a concussion, a concussion he suffered after he says he was beaten police outside of a Mississauga night club. The football player had been standing near his car when two men approached him looking for...
