After a person has consumed alcohol, it is always a good choice to not get behind the wheel of an automobile, or to attempt to ride a motorcycle. As it turns out, however, there are other ways to end up with an impaired drivingcharge in Ontario. A man faces multiple charges after he took to the streets on two wheels after having a few drinks.
On April 29, a OPP officer on patrol noted an e-bike rider that seemed to be driving erratically. The officer conducted a traffic stop of the rider to assess the situation. He ascertained the operator had been drinking before riding the bike.
The 35-year-old male operator of the e-bike now faces several charges stemming from the incident. Although some people might not see it this way, an e-bike is a motor vehicle. Accordingly, he was charged with driving a motor vehicle while ability impaired, and care or control with a blood alcohol level above the legal limit. Additionally, the officer charged him with obstructing a peace officer.
A charge of impaired driving may seem unfair for a person on an e-bike, who may have chosen to avoid driving a car due to his condition. Once charges are laid, however, the only thing that can be done is to plan a strategy for a defence. Part of that strategy might be to consult with an Ontario criminal defence lawyer.
